First Biosimilar Receives Recommended Approval from FDA Panel
When people think of medicine, they often think of small-molecule prescription drugs made through chemical processes. However, there are a range of medicines, considered biological products, such as vaccines, allergenics, gene therapy, and proteins. These are generally made from human and/or animal materials and usually have a more complex structure than small-molecule prescription drugs. This complexity has previously prevented the development of lower-cost, highly similar versions of biological products, called biosimilars. This month, however, an FDA advisory panel voted to recommend the approval of Amgen, which could become the first biosimilar in the United States.

2015 Supreme Court IP/Patent Cases to Watch
The Supreme Court has agreed to hear two cases related to intellectual property this year, although neither are set for argument yet. In Kimble v. Marvel Enterprises, Inc., the Supreme Court will review whether to uphold a long-standing rule that licensees of a patent are only required to pay royalties during the term of a patent regardless of contract. In Commil USA, LLC v. Cisco Systems, Inc., the Court will determine whether a defendant’s good-faith belief that a patent is invalid is a defense to induced infringement.
